1. Scope
Based on the following general terms and conditions, Pfalz Safari Stefan Buhl organizes Segway tours, Segway events and other events in which Segways are used. We do not accept any regulations of the customer(s) that deviate from these terms and conditions unless Pfalz Safari Stefan Buhl agrees to these changes in writing.
2. Requirements for participation
To take part in Segway events, participants must meet both the legal requirements and the requirements specified by the manufacturer based on the technical conditions. In addition, their physical constitution must allow them to ride and they must follow the organizer's instructions. If in doubt, all details can be discussed with the organizer in advance.
In detail, the following regulations apply:
a) Legal regulations
The minimum age for using a Segway on public roads in Germany is 14 years. The road traffic regulations apply during the ride. The participant is responsible for the consequences of any traffic violations and criminal offenses he or she commits and is liable for all fees and costs resulting from them. He or she is obliged to indemnify the organizer against any claims made by third parties against him or her in connection with the use of the vehicle.
b) Technical and health requirements
All participants must be able to participate in road traffic (visual and hearing ability) and must be able to stand and climb steps without help for a longer period of time without any problems. Participants who suffer from chronic or serious illnesses (e.g. epilepsy, thrombosis, heart and circulatory diseases, back or knee problems, diabetes, Parkinson's disease and advanced stages of multiple sclerosis) must discuss possible risks and the associated possible exclusion from the tour with the tour leader before the tour begins.
For technical reasons, the body weight of passengers must be at least 45 kg and must not exceed 115 kg.
c) Regulations before and during the journey
The tour guide's instructions must always be followed. The organizer can exclude participants from the tour at any time if they are driving dangerously or are particularly clumsy, if they do not follow the tour guide's safety instructions or if they endanger themselves, other participants or third parties or property in any way. Participants who are drunk or under the influence of drugs are not allowed to take part in the tour. The consumption of alcohol is strictly prohibited during the entire event (including during any stops or similar). Eating, drinking and the use of cameras, cell phones and other devices during the ride are prohibited. Overtaking other Segways or pulling out/leaving the group is also prohibited.
In the event of exclusion from the tour, there is no right to a refund of the tour price.
Participants undertake to take part in the driving instruction that takes place at the beginning, even if they already have knowledge of Segway driving. Riding without instruction is not permitted. Participants take part in the event at their own risk.
3. Weather conditions and force majeure
Pfalz Safari Stefan Buhl reserves the right to cancel a booked tour for safety reasons in the event of heavy rain / persistent rain, severe weather, thunderstorms, snow, black ice, storm warnings, floods, force majeure or similar.
If the tour cannot take place due to bad weather conditions or force majeure and the agreed date has to be postponed, the participant must ensure that he or she can be reached by telephone in this case.
a) If we cancel a tour due to weather conditions or force majeure, we will arrange an alternative date with you to reschedule the tour. This will not incur any additional costs for you. Alternatively, you can also receive an individual voucher for each participant. This is transferable and can be redeemed for a Segway tour with us within 3 years.
b) If you do not wish to reschedule the tour on another date and do not wish to make use of our voucher arrangement, we will charge 25% of the agreed tour price as a cancellation fee.
4. Recommended equipment
The Pfalz Safari Stefan Buhl recommends that participants wear sturdy, comfortable shoes and clothing appropriate for the season. Bicycle helmets can be rented free of charge before the trip
5. Start of the event
All programs/events begin at the meeting point specified in the offer and at the agreed time.
6. Changes to the event programme
Pfalz Safari Stefan Buhl is entitled to cancel the program in the event of imminent danger and/or force majeure, to adapt the program to the circumstances, to modify it or to offer an alternative program.
7. Booking and payment
Pfalz Safari Stefan Buhl tours and events can be booked online, by phone or by email. With the confirmation of the booking, the client receives an invoice, the final amount of which must be transferred before the start of the event. For group events, Pfalz Safari Stefan Buhl is entitled to charge a deposit of 50%, which is due immediately. The final invoice is due for payment no later than 7 days before the start of the event.8. Our issued tour vouchers are valid for three years after the year in which they were purchased.
9. Cancellation of a booking
After receipt of the registration, the customer will receive an order confirmation which makes the booking valid. In the event of cancellation by the customer, the following cancellation fees will be charged:
Cancellation up to 12 weeks before the event 20 %
Cancellation up to 8 weeks before the event 30 %
Cancellation up to 4 weeks before the event 50 %
Cancellation up to 2 weeks before the event 70 %
Cancellation up to 3 days before the event 80 %
Cancellation on the day of the event 90 %
in case of no-show 100%
the agreed contract amount. The customer reserves the right to prove that no or less damage has occurred.
10. Description of the events
All descriptions of the events/tours on the Internet portal or in printed materials have been created based on extensive tests and to the best of our knowledge. Changes in the schedule are possible and do not entitle you to withdraw, reduce the price or claim damages. All information regarding the events are guidelines and may vary in individual cases. Waiting times or deviations due to weather conditions correspond to the agreed service.
11. Limitation of own claims
In deviation from Section 195 of the German Civil Code (BGB), claims for payment expire after 5 years. Section 199 of the German Civil Code (BGB) applies to the start of the limitation period.
12. Place of jurisdiction and place of performance
The place of payment and jurisdiction for all legal disputes is Deidesheim.
13. Changes to the Terms and Conditions
Pfalz Safari Stefan Buhl reserves the right to change or supplement the General Terms and Conditions.
14. Severability Clause
Changes and additions to the contract generally require a written agreement. Should a provision of these terms and conditions be or become invalid, this does not result in the invalidity of the entire terms and conditions. In this case, an invalid provision must be supplemented by a provision or addition that corresponds to the economic purpose. Otherwise, the statutory provisions apply.
